CPAP Lawsuit

CPAP Lawsuit

Recent studies have shown that continuous positive airway pressure (CPAP) machines that are used to treat sleep disorders can cause respiratory infections and serious diseases including many types of cancer. Anyone who has used one of these devices to treat sleep apnea and been subsequently diagnosed with a related condition is eligible for the litigation against the manufacturer.

CPAP machines are commonly prescribed by doctors to treat sleep disorders. The most common sleep disorder, obstructive sleep apnea, is caused by the collapse of the throat muscles and soft tissues, which temporarily stops the breathing process. This is often followed by a large gulp of air, causes loud snoring noises, and disrupts sleep patterns. Long term effects of sleep apnea include hypertension and increased risk of heart attack and stroke. The CPAP machines provide pressurized air when the wearer exhales, which forces the airways to stay open, allowing enough oxygen for undisturbed sleep.

CPAP Infections and Diseases

Current litigation focuses on the fact that the makers of CPAP machines, including ResMed and Philips Respironics, knew their devices could cause serious side effects. Users have been exposed to possible carcinogenic and toxic effects from a foam used in the devices. The foam can be inhaled as a gas or fine particulate matter or ingested. The foam can cause cause cancer, respiratory issues, and other significant health issues for CPAP wearers.

The polyurethane foam is used by the manufacturers to dampen the sound of the devices, as they are often said to be quite noisy even with the foam. However, during the testing phase, manufacturers such as Phillips discovered that the foam could degrade to the point that it is able to be inhaled or ingested. The inhalation of this substance into the body has been linked to many types of cancer, organ damage, inflammations, lung disease and poisoning. Despite this, there were no warnings to consumers.
